Terms and Conditions

These Terms and Conditions apply to the use of Timmy, provided by Nuwis GmbH, Fritz-Tarnow-Str. 2A, 22869 Schenefeld, Germany. Only these terms apply unless we expressly agree otherwise in writing.

The service is intended only for entrepreneurs and business customers. Contracts with consumers are excluded.

Timmy is an AI-powered marketing automation tool for topic discovery, creation of text, images and scripts, and publishing to connected channels. The exact feature set depends on the booked plan and may be developed further where reasonable.

Use requires a user account. Customers must provide accurate information, keep access credentials confidential and are responsible for activity through their account.

Timmy is offered in different plans. Unless stated otherwise, a free trial does not automatically become a paid plan.

The customer must not misuse the service and is solely responsible for the legality of entered, approved and published content.

• The customer must hold all required rights and consents.
• Illegal, misleading, offensive or harmful content is prohibited.
• The terms of connected third-party platforms must be observed.

The customer must review generated content before publication.

Content is generated with AI systems and may be incorrect, incomplete or unsuitable. We provide no warranty for accuracy, completeness, timeliness or legal permissibility.

Where transferable rights arise, we grant the usage rights required for the agreed purpose. The customer remains responsible for lawful use.

The service can connect third-party accounts and publish through their interfaces. The respective providers are responsible for availability, scope and terms.

The prices stated at booking apply. Business prices are plus statutory VAT where applicable. Billing is usually in advance. If payment is overdue, we may suspend access after prior notice.

Paid contracts run for the selected term and renew unless terminated at the end of the billing period. Termination can be sent to info@nuwis.de or through functions provided in the service.

We strive for high availability but do not owe uninterrupted availability. Maintenance, third-party outages and force majeure may temporarily restrict access.

We are fully liable for intent, gross negligence and culpable injury to life, body or health. For simple negligence, liability is limited to breach of essential contractual obligations and typical foreseeable damage. Further liability is excluded where legally permitted.

Information about personal data processing is available in our Privacy Policy. Where we process personal data on behalf of customers, the parties conclude a data processing agreement under Art. 28 GDPR.

We may amend these terms for the future where there is a valid reason and the customer is not unreasonably disadvantaged.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Where legally permitted, venue is our registered office. Invalid provisions do not affect the remaining terms.
